Depositor Terms: <\/i>terms that apply to depositing datasets.<br \/>\n<i>3. Depositor Terms<\/i> &#8211; <a href=\"https:\/\/dans.knaw.nl\/en\/legal\/processing-addendum-data-stations\/\" target=\"_blank\" rel=\"noopener\"><i>Processing Addendum<\/i><\/a>: terms that apply to processing personal data.<\/p>\n<p><span style=\"font-weight: 400;\">This overview explains, in broad terms, the most important changes in relation to the standard contracts for EASY.<\/span><\/p>\n<p><strong>What are the differences between the Data Stations Terms of Use and the EASY contracts?<\/strong><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>1.<em> User Terms<br \/>\n<\/em><span style=\"font-weight: 400;\">These terms apply to both <\/span><i><span style=\"font-weight: 400;\">Users<\/span><\/i><span style=\"font-weight: 400;\"> and <\/span><i><span style=\"font-weight: 400;\">Depositors<\/span><\/i><span style=\"font-weight: 400;\">. You can find the <\/span><i><span style=\"font-weight: 400;\">User Terms<\/span><\/i><span style=\"font-weight: 400;\"> in the <\/span><a href=\"https:\/\/dans.knaw.nl\/en\/legal\/terms-and-conditions-data-stations\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Terms of Use<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">New:<\/span><\/p>\n<ul>\n<li>The terms for removing an account have been tightened.<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is now explicitly required to respect the conditions for reuse of a dataset.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS asks users to handle their account in a responsible manner and to notify DANS of any misuse.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS has the right to change the Terms of Use unilaterally. This means the <\/span><i><span style=\"font-weight: 400;\">User <\/span><\/i><span style=\"font-weight: 400;\">and <\/span><i><span style=\"font-weight: 400;\">Depositor Terms, <\/span><\/i><span style=\"font-weight: 400;\">as well as the<\/span><i><span style=\"font-weight: 400;\"> Processing Addendum <\/span><\/i><span style=\"font-weight: 400;\">can be changed without your consent.<\/span><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Unchanged:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS asks the user to provide valid and stable contact details.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS keeps processing personal data responsibly. You can find details on this in our <\/span><a href=\"https:\/\/dans.knaw.nl\/en\/privacy-declaration\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">privacy statement<\/span><\/a>.<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>2. <em>Depositor Terms<br \/>\n<\/em><span style=\"font-weight: 400;\">These terms only apply to <\/span><i><span style=\"font-weight: 400;\">Depositors<\/span><\/i><span style=\"font-weight: 400;\">. You can find the <\/span><i><span style=\"font-weight: 400;\">DepositorTerms<\/span><\/i><span style=\"font-weight: 400;\"> in the <\/span><a href=\"https:\/\/dans.knaw.nl\/en\/legal\/terms-and-conditions-data-stations\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Terms of Use<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">New:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><i><span style=\"font-weight: 400;\">Depositor Terms<\/span><\/i><span style=\"font-weight: 400;\"> apply to all datasets deposited in the Data Station. There is no contract per dataset.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS sets out the policy for processing datasets in the <\/span><span style=\"font-weight: 400;\">DANS <a href=\"https:\/\/dans.knaw.nl\/wp-content\/uploads\/2023\/03\/DANS-Data-Stations-Policy.pdf\" target=\"_blank\" rel=\"noopener\">Data Stations Policy<\/a>.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS requires that obligations from a funder or organisation with regards to the dataset are met and that the publication of the dataset is not in conflict with obligations of a third party.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">When the depositor asks DANS to change or remove published datasets, both parties will discuss the best course of action in the light of the <\/span><span style=\"font-weight: 400;\">DANS <a href=\"https:\/\/dans.knaw.nl\/wp-content\/uploads\/2023\/03\/DANS-Data-Stations-Policy.pdf\" target=\"_blank\" rel=\"noopener\">Data Stations Policy<\/a>.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS is entitled to react to an <\/span><i><span style=\"font-weight: 400;\">Access Request <\/span><\/i><span style=\"font-weight: 400;\">on behalf of the depositor when the response fails and has the right to take over the role of the depositor.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS is entitled to keep datasets in the Data Station when the depositor terminates his\/her account, unless the depositor chooses a transfer of the dataset to a suitable, alternative, archive. The period of notice remains 6 months, but can be shortened when the transfer takes place earlier.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Unchanged:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Depositing datasets is non-exclusive: depositors are free to publish their datasets simultaneously elsewhere.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS is entitled to modify metadata and files, however never in content, to ensure that the dataset remains findable, accessible and readable.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS offer the service free of charge as long as the total volume of datasets is below 50 gigabytes.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A dataset has to meet certain requirements, under which that the dataset is legally processed by the depositor.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Files in a dataset are directly accessible or restrictions apply. A \u2018Permission Request\u2019 is now called an \u2018Access Request\u2019, the functionality is the same.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">When the depositor falls away, or his\/her organisation, DANS is entitled to keep the dataset in the Data Station and to appoint a successive Depositor or to do whatever is reasonably necessary with a view to achieving its objectives, including to appoint itself as the Depositor.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DANS remains liable in the same way.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>3.<em> Depositor Terms | Personal data &#8211; Processing Addendum<br \/>\n<\/em><span style=\"font-weight: 400;\">You can find the <\/span><i><span style=\"font-weight: 400;\">Depositor Terms<\/span><\/i><span style=\"font-weight: 400;\"> in the <\/span><a href=\"https:\/\/dans.knaw.nl\/en\/legal\/terms-and-conditions-data-stations\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Terms of Use<\/span><\/a><span style=\"font-weight: 400;\">. You can find the <\/span><i><span style=\"font-weight: 400;\">Processing Addendum<\/span><\/i> <a href=\"https:\/\/dans.knaw.nl\/en\/legal\/processing-addendum-data-stations\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">New:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><i><span style=\"font-weight: 400;\">Processing Addendum<\/span><\/i><span style=\"font-weight: 400;\"> is digitally concluded via the <\/span><i><span style=\"font-weight: 400;\">Terms of Use<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The depositor determines the accessibility of personal data as long as this is one in a responsible manner.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">When personal data shows to be insufficiently protected is DANS entitled to change the metadata, licence and\/or access restrictions to this end.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The retention period is standard set to indefinitely under the conditions of the <\/span><i><span style=\"font-weight: 400;\">Terms of Use.<\/span><\/i><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">When the depositor asks DANS to change or remove published dataset, both parties will discuss the best course of action in the light of the DANS <\/span><a href=\"https:\/\/dans.knaw.nl\/wp-content\/uploads\/2023\/03\/DANS-Data-Stations-Policy.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Data Stations Policy<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">When the account is terminated or when the depositor falls away or his\/her organisation and there is no successor appointed, DANS is entitled to appoint a successive Depositor or to do whatever is reasonably necessary with a view to achieving its objectives, including to appoint itself as the Depositor.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Unchanged:<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">DANS is a processor for personal data in a dataset. With the exclusion of personal data which are required for the scientific justification of the Dataset (such as the author, the rights holder etc.). DANS will be considered the controller for these personal data.<\/span><\/li>\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">DANS keeps processing personal data responsibly.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<pre>\u00a9 DANS.
